"Facta non verba" : an experiment on pledging and giving

International audience; We design an experiment to investigate whether asking people to state how much they will donate to a charity (i.e., to pledge) increases their actual donation. Individuals’ endowment is either certain or a random variable. We study different types of pledges, namely, private, public and irrevocable, which differ in terms of the cost to the individual for not keeping the promise. We show that in absence of endowment uncertainty, private and public pledges are associated with lower donations as compared to donations in the no-pledge case: private pledges slightly reduce donations and public pledges reduce them more significantly. The process of modernization and innovation in the agricultural sector requires careful analysis regarding financial resources and the need to strengthen economic structures within it. The specific discipline of agricultural credit is different from that provided for other productive activities. The "naturalness" of the agricultural product is reflected in the incidence of credit risk. These economic evaluations, which are at the basis of what is known as agricultural exceptionalism, have repercussions on the legal system of access to credit, requiring, for example, a differentiated system of evaluation of creditworthiness.

This study concerns the legal situation of a receivable secured by a registered pledge in a debtor’s sanation (restructuring) proceedings. The registered pledgee has a special position in the course of such proceedings. The study discusses the rules of subjecting the receivable secured by the arrangement, the rules of preparing and contesting the list of receivables, and finally the rules of satisfying the pledgee.

Opracowanie poświęcone jest zagadnieniu uprawnień zastawnika zastawu rejestrowego w postępowaniu sanacyjnym. Zarówno zastaw rejestrowy jak i postępowanie sanacyjne to instytucje hybrydalne. Na ich tle powstaje zatem szereg interesujących zagadnień prawnych. W opracowaniu omówiono status w postępowaniu sanacyjnym wierzytelności zabezpieczonej zastawem rejestrowym.
